Our expertise in trademark law covers all aspects relating to trademark registration, licensing and litigation, including trademark infringement and validity litigation.
Trademarks are an essential immaterial asset of businesses which permit to distinguish and value products and services vis-à-vis these of competitors.
In France, like in other EU member states, trademark protection may be obtained by a national trademark registration or a Community trademark registration having a unitary effect in all EU member states.
We assist our clients in the defining and implementing
a global protection strategy of their trademarks, coordinate adequate searches, and conduct the actions necessary to protect and defend their rights.
We represent them during prosecution of trademark applications before the French and EU offices, the National Institute of Industrial Property (INPI) and the Office the European Union for Harmonisation of the Internal Market (OHIM).
We also represent and assist our clients in opposition proceedings.
We
provide advice to our clients in the management of trademark
portfolios and assist them in drafting and negotiating trademark transfer and license agreements.
We
assess the quality of their protection, in particular in the framework
of audits (due diligence) on the occasion of mergers and acquisitions.
We
analyse the policy and strategy of their competitors and, if need be,
coordinate and implement the measures necessary to obtain freedom to
operate.
Prior to commencing infringement proceedings, we prepare and conduct the judicial actions to gather evidence of trademark infringement, by means of a saisie-contrefaçon.
We represent and assist our clients before courts in all litigation involving trade marks, at all stages, including:
- trademark infringement proceedings
- trademark nullity proceedings
- trademark cancellation proceedings
- proceedings to claim ownership of a trademark
- proceedings to obtain interim injunctive relief
- proceedings before court appointed financial experts
We also intervene in UDRP proceedings aimed at the cancellation or the transfer of domain names conflicting with trademarks.
